Welcome back. I am here with Mike White from the Floyd Hunter Injury Law Firm, and we’re talking distracted driving. Thanks for being here, always good to see you.

Attorney Mike White:

Thanks for having me again.

Olivia:

To see you outside of your commercials, you know, I’m seeing you here live in the flesh.

Attorney Mike White:

Olivia:

Right! You are an actual person. Alright, so we’re talking about distracted driving. You handle a lot of these cases?

Attorney Mike White:

I do. Probably half the cases that I have that aren’t, you know, just obvious other types of cases where someone was drinking or something, are distracted cases.

Olivia:

Well, we were talking about this in our last hour, and I find this very, very interesting: they can prove that you were texting. Even if you say, “I wasn’t texting,” there is proof out there to show that you were.

Attorney Mike White:

Well, there’s a very great deal of proof, not only of your texts. Your phone, typically even if you’ve deleted it with the right expert, can download the contents of lots of texts and videos and anything else that you might have had on there.

Olivia:

And this is on your cloud, I’m guessing, you know, even if you—

Attorney Mike White:

No, not necessarily.

Olivia:

So, they can subpoena the phone?

Attorney Mike White:

Yeah, correct.

Olivia:

The actual device?

Attorney Mike White:

Correct. For example, I had a case last year. We sent the phone, an old iPhone, to an expert in Clark County, of all places, Southwest Alabama, and he used very expensive software to download everything that was on the phone. And it was thousands of pages. It was thousands of texts, and it was about probably 400 pages of stuff printed. It was everything he’d ever texted, deleted, got rid of. It was remarkable. Photos, things that you’d never expect.

Olivia:

Wow. And now you’re defending the people who get hit by texting drivers sometimes, or do you do both?

Attorney Mike White:

I used to, now I’m just on the other side.

Olivia:

So you’re on the other side, I’m sorry.

Attorney Mike White:

That’s right, there for a long time. Our firm represents people who have been injured by people who have been distracted driving.

Olivia:

Correct, yes.

Attorney Mike White:

And you know, it’s just about 9 or 10 people get killed every day in the United States from distracted driving. You know, some 400,000 people a year get hurt from distracted driving, and it’s never been more prevalent than it is now with all the cell phone users.

Olivia:

Alright, so somebody that has been hit by somebody who’s been texting or just distracted, just as general, they can call you?

Attorney Mike White:

Hey, a lot of times you can get quite a settlement from this type of thing.

Attorney Mike White:

The biggest cases, the two biggest cases that I’ve personally ever handled involved cases where 18-wheel truck drivers were distracted. One looking down, and we never really got more than he admitted, looking down, and one looking at a phone and rear-ended people. And yes, so they’re very significant cases, often.
